Terminating a Disabled Employee

  disability

What are the Employer’s obligations when they have a disabled employee?  This is probably one of my most asked questions.  Although this question can have most Human Resources Specialists running in the opposite direction and recommending you contact your Lawyer.  A Human Resources Specialist is a good place to start.

It seems there is no easy answer or one solution to this question.

Benefits Canada has recently completed an article that I feel is well thought out and gives direction or at least a place to start, on how to handle a disabled employee.

This is a small section out of the article and I encourage everyone to read the entire article.  “An employer could choose to continue the benefits for the entire length of the disability or a specified period of time, such as the own occupation period or according to a graded schedule based on the employee’s service. As a result, it needs a well-written human resources policy to set out its intentions and practices.”
